Indian Law Degrees Now Recognized in Canada

Authorities have announced that graduates of three-year, full-time law degrees from any Common Law country, will now have their degree recognized in Canada. Graduates from countries including Australia, England and India will now be able to practice law in Canada without having to redo much of their undergraduate studies.

Law professionals from these countries will still be required to pass a series of exams to ensure that they are familiar with Canadian standards and processes, but the recent change will make the transition much easier for immigrants from these countries looking to practice law in Canada.

Foreign credentials recognition has become a large problem for immigrants coming to Canada, where taxi cab drivers often hold professional university degrees. Minister of Citizenship, Immigration and Multiculturalism, Jason Kenney, has made it a focus of his time in office to improve the situation. Currently under review, he claims that great changes will be made within the year in order to make foreign credential recognition easier for immigrants to Canada.

Am I entitled to file a lawsuit if I think I have been affected by asbestos?

You can only file a law suit if you have definitely been affected by asbestos, which means seeking medical assistance and getting a diagnosis of mesothelioma as soon as possible. Once your diagnosis has been confirmed by your doctor, you should then seek legal assistance as soon as possible to file your lawsuit for compensation. Your lawyer will need to have details of your diagnosis in order to put together your law suit.

Who will I be suing?

This all depends on your situation and where, when and how you were exposed to asbestos. You may have been exposed by your employer many years ago; your exposure may have been the result of a faulty product that contains asbestos; or you may have been exposed through contact with someone that worked with asbestos. What if I have missed the deadline within which I can file a claim?

You must always seek legal advice within the statutes of limitation as according to your state, as this will maximise your chances of a successful lawsuit. However, if for any reason you have missed the deadline, there is no harm in contacting a lawyer anyway to see whether there is anything that can be done. Your lawyer may have an idea of how to get around this, but a missed deadline normally means that your chances of success are slim


What is Mesothelioma?

Mesothelioma, a disease caused only by exposure to asbestos, only strikes an estimated 3000 US citizens a year, but it’s effects can be felt by each and every one of us throughout the entire population.

What really hit’s home with the stories of those suffering from Mesothelioma, however, is how much they are just like everybody else; they worked for years to provide for their families, the people we see each morning at the coffee shop, the man who repairs your car with a smile, the elderly wife you see in the aisles of the local grocery store, your next-door neighbors, your friends.

They are no different than anyone of you, and yet they are fighting each and every day for their survival.

A mesothelioma diagnosis is generally tested for in one of two ways. Depending on the condition of the patient, the doctor may want to do a minimally intrusive procedure called a needle biopsy. The procedure allows the doctor to abstract cells suspected of cancer infection from the lining affected area. The doctor can run tests on the mesothelial cells to determine the proper diagnosis for the patient. There are several ways in which the doctor can perform a tissue biopsy in order to run tests for mesothelioma. A thoracoscopy or laparoscopy entails making a small incision and using a tiny camera to look at the affected area. At this time a small tissue sample can be taken. The tissue samples will be sent away to a pathologists for further tests. Your doctor may decide to do a needle biopsy, where a hollow needle is inserted through the skin and into the chest cavity. However, needle biopsies can be less than precise.


The second more common way that doctors test for mesothelioma is to surgically enter the patients body, at which time they cut a small piece of infected tissue for biopsy purposes. This test is known as an "open biopsy". The abstracted tissue is then sent out for testing by a specialist. This process generally takes several days. If this test reveals the presence of mesothelioma the doctor will determine whether the diagnosed mesothelioma is benign or malignant.

Generally, the oncologist will start the patient on a series of chemotherapy treatments to slow the growth of the mesothelioma. If the doctor determines, after running tests, that the patient is not a candidate for chemotherapy, the oncologists may prescribe medication to help the patient with pain management.

 ALIMTA

A mesothelioma patient should request information on Alimta. Alimta is a relatively new type of cancer treatment being developed by Eli Lilly. In the past, a mesothelioma patient had to meet strict criteria in order to qualify to participate in the clinical trials of this treatment. However, the good news for patients and their families is that this procedure has recently been approved by the FDA and is the first treatment proven to significantly increase the length of survival in patients while at the same time alleviating significant symptoms associated with this disease.

CISPLATIN

Cisplatin is a form of chemotherapy used to treat mesothelioma. It is in a class of drugs that are designed to slow or stop the growth of cancer cells and is passed into the body intravenously. Because Cisplatin affects good cells as well as cancer cells, patients taking Cisplatin may experience side effects. As with any medication, patients are smart to report any potential side effects to a doctor immediately.

Cisplatin is often used in combination with Alimta. Patients taking Cisplatin in combination with Alimta have longer average life expectancies than patients taking Cisplatin by itself. Cisplatin must only be administered by a certified healthcare professional or caregiver. Alimta (pemetrexed) in combination with Cisplatin (Platinol®) was recently approved by the United States Food and Drug Administration (FDA) for the treatment of inoperable malignant mesothelioma.

Your treating physician will let you know if you are a candidate for this type of chemotherapy regimen.

IMMUNOTHERAPY

This type therapy requires the removal of a mesothelioma patient’s affected cells, activation of those cells and reintroduction into the infected peritoneum. This procedure is often done in conjunction with other forms of chemotherapy. It is generally thought that a patient in the very early stages of mesothelioma, would benefit the most from this procedure. In fact, initial studies have shown that in some cases the procedure has been successful in “shrinking” the mesothelioma tumor.

GENE THERAPY

The study surrounding this type of therapy has showed tremendous results in animals, but the affects of the treatment in human trials have been much less successful. This type of Therapy is one that your doctor would need to look at very closely in order to determine if you or a loved one would be a viable candidate. Often times this type of therapy is done in combination with other chemotherapy options. Unfortunately, the results have not been consistent.

PHOTODYNAMIC THERAPY

This type of new therapy involves ingesting a drug that makes the cancerous cells extremely sensitive to particular wave lengths of lights. This requires a surgical procedure, and to date, the procedure has not had any definitive results showing increased survival rates.

MULTIMODALITY THERAPY

Mesothelioma is a very difficult cancer for doctors to treat. The medical community is always seeking to learn of new and more effective ways for treating this condition. Surgery, chemotherapy and radiation are all being studied in order to hopefully find a cure mesothelioma patients.

Who has the right to file for compensation for mesothelioma?

A mesothelioma lawsuit can be filed by a person who has developed mesothelioma through exposure to asbestos. In the event that the person has passed away, the lawsuit can be filed by a family member or the executor of the deceased’s estate. A lawsuit can also be filed by a family member who has developed the disease through close contact with the person who was exposed to asbestos.

How long does the process take?

The process can take quite a while, although there is no set time and some lawyers will get your case sorted faster than others. The more research that is required to put a solid case together, the longer it will take.

How long do I have to file my claim?

This differs from state to state but generally the time limit is one to two years from diagnosis. It is important that you check on the time limitation for your state and act within the limitations otherwise you may not be eligible to claim. If you are claiming on behalf of the deceased, time limitations still apply and it is probably even more important to act quickly because of the time limits and the research required by the lawyer.

What if I don’t know where and when I was exposed to asbestos?

It is helpful if you know this and will certainly speed up the process, but if you don’t remember the lawyer will be able to help. A private investigator can be hired through the lawyer (paid for by the lawyer) who will do the necessary research to clarify when and where the exposure took place and which company or companies are responsible.

How can I afford legal assistance?

You won’t need to worry about having cash up front because mesothelioma lawyers usually work on a no win no fee basis. You will not have to pay a penny unless you receive compensation, and then the lawyer will take a percentage of the compensation as his fee.

How much will I get?

It’s impossible to say how much you will get as it depends on the merits of your case. Your lawyer will discuss this with you in more detail when you go through the details of your claim, but past settlements have notched up hundred of thousands of dollars and even multi-million dollar payouts.

Switzerland for details of money which has been sent outside India
between 1947 to 2008.. The opposition party is also equally not
interested in doing so because most of the amount is owned by
politicians and it is every Indian's money.

5) This money belongs to our country. From these funds we can repay 13
times of our country's foreign debt. The interest alone can take care of
the Centers yearly budget. People need not pay any taxes and we can pay
Rs. 1 lakh to each of 45 crore poor families.

6) Let us imagine, if Swiss Bank is holding Rs. 70 lakh Crores, then how
much money is lying in other 69 Banks? How much they have deprived the
Indian people? Just think, if the Account holder dies, the bank becomes
the owner of the funds in his account.

7) Are these people totally ignorant about the philosophy of Karma? What
will this ill-gotten wealth do to them and their families when they
own/use such money, generated out of corruption and exploitation?

8) Indian people have read and have known about these facts. But the
helpless people have neither time nor inclination to do anything in the
matter. This is like "a new freedom struggle" and we will have to fight
this.

Canadian Permanent Residency in only 6 to 12 months for Skilled Workers


All Federal Skilled Worker applications received on or after February 27, 2008 will now be assessed for eligibility according to a new regime as mandated by Minister of Citizenship and Immigration Kenney.
The new instructions created Three (3) revamped streams for FSW applications to be processed according to the following criteria:

• have an offer of "arranged employment" from a Canadian employer (i.e. approved by HRSDC), or
• be a foreign national living legally in Canada for 1 year as a temporary foreign worker or an international student,
• OR
• Be a skilled worker who has at least 1 year of experience within the past 10 years in one or more of 38 designated occupations.

The Minister has instructed that for those applications that meet the above thresholds [1 of 3 FSW scenarios above and have 67 points] that they should be processed within 6-12 months!

As far as the time required, the Department of Homeland Security in the U.S. handles H-1B petitions; once you have an approved the petition, the wait time for an H-1B visa interview is minimal. Vice Consul E answers, Your visa application is valid for up to one year from the date of your initial interview. You can certainly apply for a petition with a different employer, but this would be a new case - not a continuation of your case that is currently pending under section 221(g).

Vice Consul K answers, Hi MJ. We're sorry for the confusion. If your wife has a visa already stamped in her passport, you should be fine. She may be asked a few simple questions regarding her marriage, but name change issues, especially with regards to marriage and H1/H4 visas, are common. If she does not have a visa stamped, we will do the updating of her name. She does not need to pay an additional fee -- she'll simply have to fill out a new form.

Have her submit her old and new passport to VFS and we will make sure the correct name gets on the visa. This is a common problem, and you do not need to pay an extra fee to get it solved.

I cleared the selection process and followed up with a subseqent application. I asked my consultant about the details of the application like applicatio number etc. Finally, they gave me a receipt number and asked me to check the site for the status. The receipt number was fine but my name wasn't mentioned for the receipt. Is there any way to confirm this? Moreover, i heard that US consulate isn't approving h1b visa stamping, if the duration of work is long term. Is this the case? I also heard that US department is rejecting transfer of h1b visas, as they claim locals are unemployed, is this so?

Vice Consul K answers, Rahul -- I'm actually not clear on what is happening with your hiring process. If you have an approved HDFC receipt, you can go to VFS (www.vfs-usa.co.in) to start the application process. It is absolutely NOT true that the Consulate is not approving H1Bs. I personally did a number of H1B visas today, and have done many in my time in Mumbai. If you have an approved I-797, are qualified for an H1B, and if your petitioner can show that work exists for you in the U.S., your visa will be approved.

I wanted to confirm one thing that is if I show work experience from a small IT company, where actually I have worked, company provides me employment documents required, but suppose I am not taking salary from that company from last few months because the financial condition of the company was bad and before that I was getting paid in CASH, can this count under work exp. fraud if I show this work experience, because I will not be able to show anything in the bank statements? what do they verify for work experience? Another thing is that if I am working in my father's business, which is real estate and construction, almost all transactions are in cash. What evidence can be shown to justify work experience in this form? and no bank account evidence are possible because business is not a registered company and nither I am taking any fixed salary?

Vice Consul E answers, Hi NoOne - good question. If you actually worked there for the necessary time frame, there are a number of ways to verify the information. You aren't going to be refused simply because you don't have the right back statements. Experience certificates/letters are a good start, of course, but they aren't the only thing you can show. Of course, if you didn't work there, there are a number of ways to verify this as well on our end. In any case, there's a significant educational component in qualifying for an H-1B visa as well.

You can't have an L-1 and H-1B simultaneously - one is an intracompany transfer visa, and the other is to work for a specific US company. They are inherently incompatible, so if you want/need the L-1, we'll have to cancel the H-1B (not a adverse/negative cancellation, of course)

Vice Consul K answers, Complex question, Suraj. An L1 is an intra-company transferee visa. That is, you work for Company X in your home country and are going to work for that same company in the U.S. The major qualification for an L1 is work experience with the petitioning company. An H1B is a visa is a visa for a skilled worker. H1Bs are for individuals who qualify for specialty occupations through education, work experience, or a combination of the two. They must be hired by a company in the U.S. that can show they have legal full time employment. Both of these are visas for individuals who will be receiving a salary, in U.S. dollars, while in the U.S. In contrast, a B1 is for someone traveling to the U.S. for a period of less than 6 months. This can be for business discussions, to see the Grand Canyon, or to visit a relative. You may not work in the U.S. on a B1 visa.

If they have a client lined up for you with a real job ready for you on arrival, that's ok. Sitting "on the bench" while you aren't being paid is a very bad thing - it's illegal.

You are never without a job

how can you make sure you are never without a job? Follow these 6 steps below.



1. Tell Yourself That You Will Always Be Employed
What you say matters. Your words have power, meaning, and intention. When you tell yourself something bad will happen to your job, this will probably happen. If you tell yourself that you are marketable and confident that you will always be working, your words can make this true.



2. Anticipate Trends In Your Industry
If your job is being eliminated or outsourced, you want to know about it before you are in the room with human resources telling you that your job is going away. Research your industry. Know what's happening and what the experts say will happen. This way you can make informed decisions. Look for trends. When you find them, start to train yourself in these areas. Knowledge is power. Having the right skills at the right time ensures that, no matter what is happening around you, you will be needed and employable.



3. Have An Updated Resume
Your resume showcases your skills and abilities to the world. It is a selling tool that outlines your unique qualifications so an employer can see, at a glance, how you can contribute to the employer's workplace. When you are looking for work, prospective employers know immediately whether you are a fit for a position. If you are not looking for work, your resume reminds you of the contributions you make on a regular basis, something you can easily forget when you are immersed in the day-to-day. Whether you are looking for a job, or you have one, an updated resume is essential for your career.



4. Create A 30 Second Introduction
Whether you are looking for a new position now or sometime in the future, your 30-second introduction is an important tool for your job search. It creates an impression, and you want the impression to be a good one. Information to include in your introduction is: 1) Your name, 2) Type of position you seek specifically, 3) Your skills and strengths, 4) Background or accomplishments. Where job seekers go awry in the 30-second introduction is they are not specific enough. Without a few brief and clear details, the listener cannot understand what they want and won't refer them because they do not know what they are looking for. Example: "I have a background in finance and can do pretty much anything in this area." Versus "I am looking for a CFO job in a large manufacturing company located in the NYC area." The more specific you are in your 30-second introduction the better results you will achieve.



5. Network On A Regular Basis
If you start to network only when you need something, you will have a lot of catching up to do. Therefore, network every day. Wherever there are people, there is an opportunity to network. You do not always have to go somewhere to network successfully. You can network within your own company. Are there opportunities for you? Ask people and find out. They are your best resource for information. Invite co-workers to lunch. Take the time to walk by someone's office to say hello. In addition, who can you tap into outside of where you work? Every industry has an association. When is your industry's association meeting in your area? Check the date and go. Get involved in this group so more people can get to know you. So, if something happens to your job, you'll have people to reach out to. Lastly, send e-mail or call people you know already on a regular basis. If you are always keeping in touch, then you will not feel bad that you are bothering someone when it's time to reach out and ask for help.



6. Always Be On The Look Out For New Opportunities
Read trade publications. Read memo's not only from your area, but others. Think about what you could be doing differently. Get your creative juices flowing. Think positively. Rather than "it cannot happen," believe that what you want is possible and is within your reach. Then, make it happen.

Always collect your thoughts before speaking; that way you’ll be more confident about your answer and hence chances of rambling are less.

Never feel threatened as it’s not personal. May be the question was put to you to see how you think on the spot. It’s never a cross-examination and there’s never a time limit attached to a question. You’re never on a buzzer and so never hurry.

When uncomfortable, break down the question and tackle it part by part. If you aren’t sure how to answer any question, ask for clarification. If you still can’t make any headway, or if you’re not sure of how to answer, just excuse yourself by saying sorry you don’t know about it. This in fact is much better than waffling your way through with a poor incomprehensible answer.



You’re not expected to be an encyclpedia. So, how you conduct yourself with a critical question is more important than the actual answer. Remember, an unexpected question is a good chance to show off your character and personality. And the old proverb “honesty is the best policy” works best in these situations. But when you’ve something positive to talk about, don’t be overcome by false modesty. Remember, the key is to be honest and be yourself. Then, you’ll be able to stave off the crisis as the interviewer can see through you.

A sales rep, an administration clerk and the manager are walking to lunch when they find an antique oil lamp. They rub it and a Genie comes out in a puff of smoke.

The Genie says, "I usually only grant three wishes, so I'll give each of you just one." "Me first! Me first!" says the admin clerk. "I want to be in the Bahamas, driving a speedboat, without a care in the world." Poof! She's gone.

In astonishment, "Me next! Me next!" says the sales rep. "I want to be in Hawaii, relaxing on the beach with my personal masseuse, an endless supply of pina coladas and the love of my life." Poof! He's gone.
